Personal data (hereinafter mostly referred to as “data”) will only be processed by us within the scope of necessity and for the purpose of providing a functional and user-friendly APP, including its contents and the services offered there.

According to Article 4 paragraph 1 of Regulation (EU) 2016/679, i.e. the Basic Data Protection Regulation (hereinafter referred to as “DSGVO”), “processing” means any operation carried out with or without the aid of automated procedures or any such series of operations relating to personal data, such as the collection, recording, organisation, arrangement, storage, adaptation or alteration, reading, retrieval, consultation, use, disclosure by transmission, dissemination or any other form of provision, comparison or association, restriction, erasure or destruction, “processing” means any operation carried out with or without the aid of automated procedures, such as the collection, recording, organisation, storage, adaptation or alteration, disclosure, use, disclosure by transmission, dissemination or any other form of provision, limitation, deletion or destruction, as well as any processing of personal data, such as the processing of personal data by means of the collection, recording, organisation, storage, adaptation or alteration of such data, retrieval, retrieval, dissemination, dissemination, dissemination or any other form of provision, comparison or linkage, restriction, deletion or destruction, the destruction.

With regard to the data processing described in more detail below, users and data subjects have the right to

– confirmation as to whether data relating to them will be processed, information on the data processed, further information on the data processing and copies of the data (cf. also Art. 15 DSGVO);

– the rectification or completion of inaccurate or incomplete data (cf. also Art. 16 DSGVO);

– to the immediate deletion of the data concerning them (cf. also Art. 17 DSGVO) or, alternatively, if further processing is required pursuant to Art. 17 para. 3 DSGVO, to the restriction of processing pursuant to Art. 18 DSGVO;

– to receive the data concerning them and provided by them and to transfer these data to other providers/responsibles (cf. also Art. 20 DSGVO);

– upon complaint to the supervisory authority if they are of the opinion that the data concerning them are being processed by the provider in violation of data protection provisions (cf. also Art. 77 DSGVO).

In addition, the provider is obliged to inform all recipients to whom data has been disclosed by the provider of any rectification or deletion of data or the restriction of processing which takes place pursuant to Articles 16, 17 (1) and 18 DSGVO.  However, this obligation does not apply if such notification is impossible or involves disproportionate effort.  Notwithstanding the foregoing, the User shall have the right to obtain information about such recipients.

Users and data subjects also have the right under Art. 21 DSGVO to object to the future processing of data concerning them, provided that the data are processed by the provider in accordance with Art. 6 para. 1 lit. f) DSGVO.  In particular, an objection to data processing for the purpose of direct marketing is admissible.

III.  Information on data processing

Your data processed when using our APP will be deleted or blocked as soon as the purpose of storage no longer applies, the deletion of the data is not opposed by any legal storage obligations and no other information on individual processing methods is subsequently provided.

Processing of contracts

The data transmitted by you to make use of our range of goods and/or services will be processed by us for the purpose of processing the contract and are necessary in this respect.  Contract conclusion and contract processing are not possible without the provision of your data.

The legal basis for the processing is Art. 6 Para. 1 lit. b) DSGVO.

We delete the data with complete contract processing, but must observe the tax and commercial retention periods.

We do NOT pass on your data to third parties!

Camera and photo library use

The first time you use the APP, you will be asked if you want to allow the use of the camera. The APP only works if you make the images available to the APP. The photos are sent to the Google Vision API to digitize the readings. Afterwards the photos will NOT be saved at Google, but deleted immediately after the answer. We DO NOT see your photos! They are only stored locally on your device and are deleted again after the measured values have been exported and the data records deleted.

Location recording

When you use the functions for the first time, you can reject the location entry. Then no GPS coordinates are recorded, but of course they cannot be assigned to the measured value. We do NOT see your data! They are only stored locally on your device and are deleted again after export of the measured values and deletion of the data records.

OpenStreetMap

We use OpenStreetMap, a service of the OpenStreetMap Foundation, St John’s Innovation Centre, Cowley Road, Cambridge, CB 4 0 WS, United Kingdom, hereinafter only referred to as “OpenStreetMap”, for the location display.

When you access the measurement data page in which the OpenStreetMap service is integrated, OpenStreetMap stores a cookie on your terminal device via your Internet browser. This processes your user settings and user data for the purpose of displaying the page or guaranteeing the functionality of the OpenStreetMap service. This processing enables OpenStreetMap to recognize from which IP address your request was sent and to which IP address the display of the measuring station is to be transmitted.

The legal basis is Art. 6 para. 1 lit. f) DSGVO. Our legitimate interest lies in the optimisation and economic operation of our Internet presence.
